Terms and Conditions

These Terms and Conditions apply to personal training, hybrid coaching and online coaching supplied by Samuel Holmes, trading as Sam Holmes PT. Please read them before applying or agreeing to begin a service.
1. About Sam Holmes PT

2. Who can use the services
Services are available to adults who are able to take part safely. Clients under 18 require a parent or legal guardian to approve the service, complete or countersign required documents, and accept responsibility for payment. Sam Holmes PT may decline an application where the service is unsuitable, outside professional scope or cannot be provided safely.
Online coaching may be offered to clients outside the UK where practical, lawful and adequately insured. Any location-specific restrictions will be discussed before the agreement is formed.
3. The services
Services may include in-person personal training, online coaching or a hybrid of the two. The package, inclusions, session frequency, location, start date and any individual adjustments will be confirmed with you before coaching begins. The website is an invitation to apply and does not guarantee acceptance or availability.
Unless a different arrangement is confirmed in writing, the website packages are:
· Ignite — £199 per month
· Transform — £349 per month
· Elite — £529 per month
The exact package inclusions will be those shown or confirmed to you at the time you sign up. Any bespoke service and its price will be agreed in writing before it begins.
4. Forming the agreement
Submitting an application does not by itself guarantee a coaching place. A binding agreement is formed when Sam Holmes PT accepts you as a client, confirms the service and price, and you accept these Terms and any required onboarding documents.
Acceptance may be recorded electronically, including by ticking an agreement box, submitting an online form or signing electronically. Health-data consent and media consent are requested separately and are not created merely by accepting these Terms.
5. Minimum term and ongoing membership
Unless expressly agreed otherwise in writing, coaching has an initial minimum term of 3 months. After the minimum term, it continues on a monthly rolling basis until ended in accordance with section 14.
6. Payment
· Monthly fees are payable in advance on the agreed billing date.
· Payment will normally be collected by an approved third-party direct-debit or payment provider. The provider and any applicable payment instructions will be confirmed when your account is set up.
· You must maintain a valid payment method and pay all sums due. If a payment fails, please arrange payment promptly when contacted.
· Unless required by your statutory rights or expressly stated in these Terms, fees for a billing period that has started and booked or reserved coaching time are non-refundable.
If a fee is overdue, Sam Holmes PT may pause sessions, programme delivery and support until the account is brought up to date. This does not remove the obligation to pay sums that are properly due.
7. Your 14-day cancellation right for distance contracts
If you are a consumer and the agreement is made entirely online, by telephone or away from Sam Holmes PT’s business premises, you will normally have 14 days from the day after the agreement is formed to cancel without giving a reason, unless an exception applies.
If you ask for coaching to start during that 14-day period, you expressly request early performance of the service. If you then cancel within the period, you must pay a proportionate amount for services supplied before cancellation. If the service has been fully performed during the cancellation period after your express request and acknowledgement, the cancellation right may be lost to the extent permitted by law.
To cancel, send a clear statement to team@samholmespt.co.uk. You may use the model cancellation notice in section 25, but you do not have to. Refunds required by law will be made within the legally required period using the original payment method where practicable.
8. Health screening and your responsibilities
· You must complete the requested PAR-Q or health screening before starting and provide information that is complete and accurate to the best of your knowledge.
· You must promptly tell Sam Holmes PT about any injury, illness, pregnancy, medication, diagnosis, symptom or other change that may affect safe participation.
· You are responsible for seeking medical advice or clearance where recommended. Sam Holmes PT does not diagnose or treat medical conditions.
· Stop exercising and seek appropriate help if you experience pain, dizziness, chest pain, unusual shortness of breath or another concerning symptom.
· You must follow reasonable safety instructions and use equipment appropriately.
Failure to provide relevant information or follow reasonable safety instructions may result in a session being stopped or the agreement being suspended or ended.
9. Online coaching and remote sessions
For online coaching and remote sessions, Sam Holmes PT is not physically present to inspect your environment or equipment. You are responsible for choosing a safe, suitable space; checking that equipment
is secure and in good condition; positioning any camera appropriately; following instructions; and stopping if an activity feels unsafe.
Online guidance is based on the information and view available. It is not a substitute for in-person medical assessment or emergency help.
10. Bookings, cancellations and no-shows
· Give at least 24 hours’ notice if you need to cancel or rearrange a booked session.
· A cancellation made less than 24 hours before the start time, or a failure to attend, is treated as a late cancellation and the session is charged or deducted in full.
· If you arrive late, the session will usually still finish at the scheduled time.
· If you are more than 20 minutes late, Sam Holmes PT may cancel the session and charge or deduct it in full.
Sam Holmes PT may waive a late-cancellation charge in exceptional circumstances at its discretion. Doing so once does not create an obligation to do so again.
11. Using sessions and monthly allowances
A monthly session allowance must be used within that billing month and does not roll over. For example, one session per week provides four sessions for the relevant month; any unused session expires at the end of that month.
A separately purchased prepaid session or session block expires 3 months after purchase unless a different expiry date is confirmed in writing. Expired sessions are not refundable, subject to your statutory rights.
12. If Sam Holmes PT changes or cancels a session
If Sam Holmes PT needs to cancel a session, we will first try to rearrange it at a mutually suitable time. If rearrangement is not reasonably possible, the session will be credited or its individual value refunded. Sam Holmes PT is not responsible for indirect costs such as travel, childcare or lost earnings, except where the law says otherwise.
13. Check-ins and communication
Where included in your package, check-ins will normally take place weekly. Coaching messages are normally answered within 24 hours from Monday to Saturday and are often answered sooner. There is no guaranteed reply on Sunday.
WhatsApp or Telegram may be used for urgent coaching matters where agreed, but neither is an emergency service and an immediate response cannot be guaranteed. If you believe you have a medical emergency, contact the appropriate emergency service rather than relying on a coaching message.
14. Ending the agreement after the minimum term
After the initial 3-month minimum term, you may end the agreement by giving written notice by email. One full monthly billing period’s notice is required. The agreement and payments continue during the notice period, and you may use the services included during that period.
Notice takes effect when received at team@samholmespt.co.uk. Cancelling a direct debit with your bank or payment provider does not by itself end the agreement or remove sums properly due.
15. Pausing coaching
Membership does not automatically pause because of holiday, illness, injury, work commitments or unused sessions. Sam Holmes PT may agree a pause or variation in exceptional circumstances. Any pause, revised billing or extension must be confirmed in writing.
16. Suspension or termination by Sam Holmes PT
Sam Holmes PT may suspend or end the agreement for a serious or repeated breach, including non-payment, abusive or threatening behaviour, dishonesty, unsafe conduct, misuse of the service, failure to disclose material health information, or repeated failure to follow reasonable instructions.
Where appropriate, we will explain the concern and allow a reasonable opportunity to put it right. Immediate termination may be used where safety, serious misconduct or a material breach makes that reasonable. Services already supplied, sessions lost under the cancellation rules and properly reserved time remain payable.
If Sam Holmes PT ends the agreement for reasons unrelated to your breach and cannot provide the remaining paid service, the unused value for the current month will be refunded or credited.
17. Results and professional scope
Training and coaching outcomes vary between people and depend on factors including attendance, effort, consistency, nutrition, sleep, health and circumstances. Sam Holmes PT will provide the agreed service with reasonable care and skill but does not guarantee weight loss, muscle gain, performance, appearance or any other result.
Coaching is educational and fitness-related. It is not medical diagnosis or treatment, physiotherapy, psychotherapy or emergency care. General nutrition guidance is not a substitute for advice from an appropriately qualified healthcare or nutrition professional.
18. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.
Sam Holmes PT is responsible for loss or damage that is a foreseeable result of breaching these Terms or failing to use reasonable care and skill. Sam Holmes PT is not responsible for loss that was not foreseeable, was caused by inaccurate or withheld information, resulted from ignoring reasonable instructions, or is a business loss arising from a service purchased mainly for personal use, except where the law provides otherwise.
You remain responsible for your own actions between sessions, for the safety of your remote training environment and for deciding whether to seek medical advice.
19. Intellectual property and acceptable use
Programmes, plans, videos, guides, documents, branding and other materials supplied by Sam Holmes PT remain owned by Sam Holmes PT or the relevant licensor. You receive a personal, non-exclusive, non-transferable right to use them for your own coaching. You must not copy, sell, publish, share, adapt or commercially exploit them without written permission.
You must not share account access, upload unlawful or harmful material, interfere with a platform, or use the service in a way that infringes another person’s rights.
20. Third-party platforms
The service may use third-party platforms such as TrueCoach, email, messaging, calendars and a payment provider. Those providers may have their own terms, privacy information and availability limits. Sam Holmes PT will take reasonable steps to offer a practical alternative if a material platform problem prevents delivery, but cannot guarantee that a third-party service will always be uninterrupted.
21. Privacy, health consent and media consent
Personal information is handled as described in the Sam Holmes PT Privacy Notice at www.samholmespt.co.uk/privacy. Health-data consent is collected separately before the fitness programme begins. Optional photograph, video, audio and testimonial consent is also collected separately and may be withdrawn at any time in accordance with the Privacy Notice and consent form.
22. Changes to services, prices or terms
Sam Holmes PT may make reasonable changes to improve a service, reflect legal or safety requirements, update third-party platforms or clarify these Terms. Changes that materially disadvantage you will be notified in advance where practicable.
Price changes will not be applied retrospectively. For an ongoing monthly agreement, reasonable advance notice will be given before a new price takes effect. If a material change takes effect after the minimum term and you do not wish to accept it, you may give notice to end the agreement in accordance with the notice provided, without losing mandatory consumer rights.
23. Events outside reasonable control
Neither party is responsible for delay or failure caused by an event genuinely outside reasonable control. Sam Holmes PT will take reasonable steps to reduce disruption and will contact you where possible. If a material service cannot be supplied for an extended period, the parties will discuss a suitable rearrangement, credit or refund for the affected unused service.
24. Complaints and governing law
If you have a concern or complaint, email team@samholmespt.co.uk with the relevant details. Sam Holmes PT will try to resolve it promptly and fairly.
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, but if you are a consumer living elsewhere, you keep any mandatory rights to bring a claim in the courts of the part of the UK or other country where you live where applicable.
If any provision is found invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive that right. No other person has a right to enforce these Terms unless the law says otherwise.
25. Model cancellation notice
You may copy and email the wording below if you wish to cancel during a statutory cancellation period. A clear email containing the same information is sufficient.
